Terms of Service — Ascent Performance Lab

These Terms of Service ("Terms") govern your use of the Ascent Performance Lab Chrome extension (published as "Ascent HI"; the "Service"), provided by Ascent HI LLC ("Ascent HI," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

The Service is intended solely for professional and business use. You must be at least 18 years of age to create an account. By registering, you warrant that you possess the legal capacity to enter into a binding agreement under applicable law.

2. The Service

The Service lets you (a) generate an editable research brief about a prospect, assembled by AI from publicly available web sources; and (b) conduct live, voice-based practice conversations with an AI persona based on that brief, followed by an AI-generated coaching report. Briefs consume your brief allowance; practice calls consume session credits.

AI-generated content. Research briefs, practice personas, and coaching reports are generated by artificial intelligence. Briefs may be incomplete or inaccurate — you are expected to review and correct them before use. Practice personas are fictional simulations and do not represent the views, statements, or conduct of any real person. Coaching output is training feedback, not professional, legal, or financial advice.

3. Free Trial

New accounts receive a 7-day free trial with a daily allowance of prospect briefs and one practice call per day, no payment method required. Trials require a work email address and are limited to one trial per company. We may deny, limit, or revoke trials created to circumvent this limit (for example, through disposable or duplicate email domains).

4. Subscription, Credits & Billing

• Performance Plan — $19/month: 100 prospect briefs and up to 10 practice sessions per month. Monthly allowances reset at each billing period and do not roll over.
• Top-up packs — $10 per 5 sessions: available to active subscribers; quantity adjustable at checkout. Top-up sessions do not expire month to month while your subscription remains active.
• Payments are processed by Stripe. Prices exclude any applicable taxes. We may change pricing with notice effective at your next billing period.

5. Cancellation & Forfeiture of Credits

Canceling your subscription forfeits all remaining session credits — both unused monthly sessions and purchased top-up sessions. Your plan features remain available until the end of the billing period you have paid for; at that point any remaining credits are forfeited and are not refunded or converted.

You can cancel at any time via Manage subscription & payment in the extension's Account tab. This forfeiture is disclosed here, on the pricing page, and in-product alongside every purchase action.

6. Refunds

Except as required by applicable law, fees are non-refundable. Practice calls that end within the first 30 seconds are not scored and their session credit is returned to your balance automatically. For billing problems, contact support@ascenthi.com — we would rather fix it than argue about it.

7. Acceptable Use

You agree not to:

• Use researched contact information in violation of applicable outreach, anti-spam, or data-protection laws (e.g., CAN-SPAM, GDPR, CCPA, telemarketing rules) — compliance with such laws when you contact a researched person is your responsibility;
• Use the research feature to build, resell, or export datasets about individuals unrelated to your own genuine sales preparation;
• Research or simulate individuals for harassment, impersonation, deception, or any unlawful purpose;
• Attempt to bypass usage metering, trial limits, or security controls, or to reverse engineer the Service;
• Resell or provide the Service to third parties without a written agreement with us.

We may suspend or terminate accounts that violate these Terms. We may also suspend the Service temporarily for maintenance or to protect its integrity.

8. Intellectual Property

The Service — including its content, features, user interfaces, branding, software, and underlying architecture — is and remains the exclusive property of Ascent HI LLC and its licensors. You retain ownership of the information you enter, and you may freely use the briefs, transcripts, and reports generated for you. Nothing in these Terms grants you any right in our intellectual property except the limited right to use the Service as permitted here.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of AI-generated content. To the maximum extent permitted by law, Ascent HI's total liability arising out of or relating to the Service shall not exceed the amounts you paid us in the twelve (12) months preceding the claim, and we shall not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits or revenue.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above and, where appropriate, through in-product or email notice. Continued use of the Service after changes take effect constitutes acceptance.
